1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Beesoft Solutions Pty Ltd (ABN 73 138 033 360), the owner of the website evevolution.au and the business name EV Agent (“we,” “us,” or “our”).

This agreement concerns your access to and use of the evevolution.au website, the EV Evolution AI Agent, and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site, you confirm that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Use. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to register for the Site or use the AI booking features.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.

These are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the Commonwealth of Australia, foreign jurisdictions, and international conventions.

The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

3. User Representations

By using the Site, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.

  • You will maintain the accuracy of such information and promptly update such registration information as necessary.

  • You have the legal capacity and you agree to comply with these Terms of Use.

  • You are not under the age of 18.

  • You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise (except via standard search engine crawling).

  • You will not use the Site for any illegal or unauthorized purpose.

  • Your use of the Site will not violate any applicable law or regulation.

4. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data from the Site to create a collection, compilation, database, or directory without written permission.

  • Circumvent, disable, or otherwise interfere with security-related features of the Site.

  • Engage in unauthorized framing of or linking to the Site.

  • Trick, defraud, or mislead us and other users, specifically regarding sensitive account information.

  • Misuse our support services or submit false reports of abuse.

  • Interfere with the EV Evolution AI: Attempt to “jailbreak,” manipulate, or inject malicious prompts into the AI Agent to make it perform tasks outside its scope or violate these terms.

  • Upload or transmit viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Site.

  • Use the Site in a manner inconsistent with any applicable laws or regulations.

5. User Generated Contributions

The Site may invite you to chat, participate in blogs, or post content (“Contributions”). By posting Contributions, you represent and warrant that:

  • Your Contributions do not infringe the proprietary rights of any third party.

  • You are the creator and owner of the Contributions.

  • Your Contributions are not false, inaccurate, or misleading.

  • Your Contributions do not violate any applicable law.

Contribution License:

By posting your Contributions to any part of the Site, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide right to host, use, copy, reproduce, disclose, sell, publish, and distribute such Contributions for any purpose, commercial or otherwise.

6. Terms of Sale for EV Charging Products

This Section governs any purchase you make on the Site for electric vehicle (EV) chargers, cables, and accessories (“Charging Products”).

  • Product Sourcing: All Charging Products are sourced directly from Australian local suppliers and are compliant with relevant Australian electrical standards.

  • Pricing & Warranty: Prices include GST. Your purchase comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

  • Installation: You acknowledge that certain Charging Products require professional installation by a licensed electrician. You bear sole responsibility for ensuring safe and lawful installation.

  • Liability: To the fullest extent permitted by law, we disclaim liability for damages arising from improper installation, misuse, or failure of any Charging Product.

7. EV Rewards Program

We may offer an EV Rewards Program to recognize user contributions.

  • Eligibility: Open to registered users aged 18+.

  • Earning Points: Points are earned by participating in site activities.

  • Redemption: Points can be redeemed for products in the EV Rewards Store.

  • No Cash Value: Points cannot be exchanged for cash.

8. EV Evolution AI Agent

The Site features an AI-powered assistant designed to provide information about Electric Vehicles in Australia. By using this feature, you acknowledge and agree to the following:

  • General Information Only: The AI Agent provides information based on its training data. It is not a financial advisor, tax accountant, or legal expert. Information regarding Novated Leases, vehicle pricing, driveaway deals, FBT, and government incentives is for general guidance only and is subject to change. You must verify all pricing and terms with the local dealership.

  • Accuracy Disclaimer & Hallucinations: Artificial Intelligence can occasionally produce incorrect or misleading information. EV Evolution does not guarantee the accuracy, completeness, or timeliness of the AI’s responses.

  • Third-Party Processing: To provide real-time conversational capabilities, your chat inputs may be securely processed by third-party AI models which may be hosted on servers outside of Australia.

  • No Liability: Under no circumstances are we liable for any financial or purchasing decisions you make based on the advice, calculations, or information provided by the AI Agent.

9. Dealership Handoff & SMS Communications (VIP Test Drives)

By utilizing our platform to request a VIP Test Drive or vehicle quote, you explicitly agree to our lead routing and communication protocols:

  • Dealership Handoff: You grant us express consent to transmit your provided details (Name, Phone, Email, Location, and Vehicle Interest) to our approved network of third-party automotive dealerships. You acknowledge that these third-party dealerships will contact you directly to facilitate your request.

  • SMS Verification & Consent: By submitting your mobile number, you explicitly consent to receive automated SMS text messages from EV Evolution (and our gateway partners, such as Twilio) for the purpose of verifying your request and providing booking updates.

  • Opt-Out (Spam Act Compliance): You may withdraw your consent to receive SMS communications from us at any time by replying “STOP” to any text message you receive.

  • Third-Party Actions: EV Evolution acts solely as an introductory concierge service. We are not a vehicle dealership and are not responsible for the actions, sales tactics, vehicle availability, or pricing offered by the third-party dealerships we connect you with.

10. Affiliate Disclosure

Our website participates in various affiliate advertising programs. When you click on a product link or banner on our website and make a purchase, we may receive a commission from the sale at no additional cost to you.

11. Third-Party Websites and Content

The Site may contain links to Third-Party Websites. We are not responsible for the content, accuracy, or privacy practices of these external sites. If you decide to access Third-Party Websites, you do so at your own risk.

12. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use.

13. Term and Termination

These Terms of Use shall remain in full force and effect while you use the Site. We reserve the right to deny access to and use of the Site to any person for breach of these Terms.

14. Disclaimer and Limitation of Liability

The Site is provided on an AS-IS and AS-AVAILABLE basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof. We make no warranties or representations about the accuracy or completeness of the Site’s content or the output of the EV Evolution AI Agent.

Limitation of Liability:

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Site, or your interactions with third-party dealerships, even if we have been advised of the possibility of such damages.

15. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of New South Wales, Australia. Any legal action shall be commenced in the state and federal courts located in New South Wales, Australia.
